Scalia's Dissent in Obergefell (Same-Sex Marriage) Case Would Criminalize Justice Thomas's Marriage

Justice Antonin Scalia's dissent in Obergefell v Hodges -- the case that declared that denying same-sex couples marriage licenses violated the equal protection and due process clauses of the Fourteenth Amendment -- is best known for its tantrums and, as usual for the politician Scalia is rather than the jurist he is supposed to be, its hypocrisy.
Missed in Scalia's childish histrionics was his so-called 'originalist' approach for interpreting the Constitution (when it suits him, that is -- those who voted on the Second Amendment could not possibly have been thinking about semi-automatic assault weapons or 25 bullet magazines, but Scalia holds that those are protected).
In Obergefell, Scalia asserts that he knows that the people who voted to approve the Fourteenth Amendment in 1868 were not thinking about same-sex marriage when they voted, and, therefore, the original intent of that Amendment prevents Scalia from finding a right to same-sex marriage in its guarantee of equal protection under the laws.
That same approach, however, would make Justice Clarence Thomas's interracial marriage illegal, and subject to criminal prosecution in Virginia, the Thomas's state of residence. As assuredly as voters in 1868 were not thinking about gay marriage when they voted for the Amendment, they certainly were not approving it to enable interracial marriages.
Interracial marriage, "miscegenation," was not only impermissible in Virginia, it was a criminal offense subject to time in jail. Citing the equal protection clause of the Fourteenth Amendment, the Supreme Court overturned the Virginia and other state statutes in the poetically-named case, Loving v. Virginia, in 1967.
According to Justice Scalia's reasoning, the people voting on the Fourteenth Amendment in 1868 did not contemplate interracial marriage as what they were protecting by passing it. Hence, Scalia would have to say that Loving was wrongly decided.
That would make Scalia's wingnut buddy, Justice Clarence Thomas and his wife Ginny, subject to imprisonment in Virginia.

Rapper Killer Mike of Run the Jewels has endorsed Bernie Sanders for president, pulling a key hip-hop endorsement from Democratic frontrunner Hillary Clinton.
Killer Mike said in a tweet  to his more than 148,000 followers that he was moved to officially endorse Sanders because of the Vermont senator’s call to restore the Voting Rights Act, which was weakened in 2013 when the US supreme court invalidated key protections in the act.
The Atlanta rapper frequently appears on news programs to provide a voice from the hip-hop community and has been increasingly vocal about politics in the past few years .
In replies to the initial tweet, Killer Mike further explained why he was choosing Sanders over other candidates.
Twitter user @TristanHerzong said he was concerned that by voting for Sanders, Killer Mike could take away a vote from Clinton, the clear Democrat frontrunner. “I cannot support another Clinton or bush ever,” Killer Mike tweeted.
“I am beginning to see American political families like monarchs and I have no affection for monarchs,” he said.
With 497 days until the 2016 presidential election, Clinton is leading the pack in celebrity endorsements – Beyoncé, Ariana Grande and Moby have all said they support her run for president.
She has also proved more popular among top hip-hop artists than the other candidates. Snoop Dogg, 50 Cent and Ja Rule all said in May that they are voting for Clinton.
Actor Chuck Norris and reality television show parents Michelle and Jim Bob Duggar have endorsed Mike Huckabee. The Duggars’ endorsement came weeks before it was made public that their son Josh admitted to molesting young girls.
In June , Killer Mike attempted to run for local office in Georgia as a write-in candidate, but learned he did not have the necessary paperwork or time to fill it out. After learning this, he said: “I will run in the future and we will win!”

Supreme Court Kicks Republicans In The Gut By Giving People The Power To Stop Election Rigging

By ruling that Arizona’s Independent Redistricting Commission is constitutional, the Supreme Court of the United States kicked plutocrat-loving Republicans in the gut.  Justice Ruth Bader Ginsberg wrote the 5-4 majority opinion, joined by Justices Breyer, Kagan, Kennedy and Sotomayer.
The crux of the majority’s reasoning can be found in last paragraph of the ruling.
Our Declaration of Independence,  drew from Locke in stating: “Governments are instituted among Men, deriving their just powers from the consent of the governed.” And our fundamental instrument of government derives its authority from “We the People.” U. S. Const., Preamble. As this Court stated, quoting Hamilton: “[T]he true principle of a republic is, that the people should choose whom they please to govern them.” Powell v. McCormack, 395 U. S. 486, 540-541 (1969) (quoting 2 Debates on the Federal Constitution 257 (J. Elliot ed. 1876)). In this light, it would be perverse to interpret the term “Legislature” in the Elections Clause so as to exclude lawmaking by the people, particularly where such lawmaking is intended to check legislators’ ability to choose the district lines they run in, thereby advancing the prospect that Members of Congress will in fact be “chosen . . . by the People of the several States,”
Even though this case got much less attention from the media compared to the health care and marriage equality cases it is in some ways as important as the aforementioned cases.  The reason is it will shape the meaning of vote equality in the years to come. Had the court ruled the other way, frankly, it would have removed the last real hope of stopping the Koch owned Republicans from rigging elections in their favor.
The question before the court was to determine the meaning of “legislature” under Article 1, Section 4 of the Constitution.
The times, places and manner of holding elections for Senators and Representatives, shall be prescribed in each state by the legislature thereof; but the Congress may at any time by law make or alter such regulations, except as to the places of choosing Senators.
The background of this case begins with a ballot measure in 2000.  Fifty percent of the people in Arizona voted to remove redistricting power from the legislature and to establish the AIRC.  The reason was simple: Arizonians were frustrated with a rigged electoral map.  Initially, the AIRC didn’t do a very good job of drawing the electoral map. As noted by Miriam Wasser, Republicans had a super majority by the end of the decade because ”the number of registered Democrats was not reflected in the election results – somewhat comparable to how a presidential candidate who wins the popular vote but loses the Electoral College loses the entire election.”
After the 2010 census, a new AIRC was elected, and they chose a different set of mapping consultants.  The Koch controlled Republicans were angry because they believed the new consultants were “too Democratic” in other words, fair.
In 2012, the Koch Republican misled legislature filed a suit claiming Proposition 106 (the ballot measure to establish the AIRC) was an unconstitutional power grab by the people of Arizona.  When, in February 2014, a three-judge panel ruled that the AIRC was constitutional, the Koch Republican misled legislature appealed to the Supreme Court.
Through this ruling, the Supreme Court placed an important limit on the Republican cabal’s efforts to silence the people.  It means that independent redistricting commissions in other states are also constitutional.  It also means that the power to stop Republican election rigging is where it belongs – in the hands of the people.

According to PPP, “In spite of KFC’s weak poll numbers Colonel Sanders remains a beloved figure, with 71% of voters seeing him favorably to only 8% with an unfavorable view. In fact they even think Colonel Sanders could be part of the solution to the problems in Washington- by a 47/27 spread voters in the state say they think Colonel Sanders would make for a better US Senator than Mitch McConnell. Too bad he’s dead.”
Kentucky voters would rather have a dead fried chicken magnate as their senator than the very much still alive Mitch McConnell. McConnell’s approval rating in the state continues to be dismal. Only 32% of Kentucky voters approval of McConnell’s job performance. Fifty-four percent disapprove. Republicans gave McConnell a slight 47%-37% approval advantage, but his approval rating with Democrats and Independents is in the 20s.
McConnell continues to prove that elections are often about who shows up to vote, not how unpopular a candidate is. Mitch McConnell is not popular in Kentucky by any measurement, but Republicans continue to hold their noses and vote for him because they believe that he is their only choice.
Kentucky’s voters have spoken, and they think that they would be better served by having a dead person represent them than they are by Mitch McConnell.
The reality is that Mitch McConnell isn’t a very good senator, and the fact that he is now losing in polls to dead people suggests that his current term should be his last.

Supreme Court Allows Texas Abortion Clinics To Remain Open

The Supreme Court issued a brief, two paragraph order on Monday permitting Texas abortion clinics that are endangered by state law requiring them to comply with onerous regulations or else shut down to remain open. The order stays a decision by the United States Court of Appeals for the Fifth Circuit, which imposed broad limits on the women’s right to choose an abortion within that circuit.
The Court’s order is temporary and offers no direct insight into how the Court will decide this case on the merits. It provides that the clinics’ application for a stay of the Fifth Circuit’s decision is granted “pending the timely filing and disposition of a petition” asking the Court to review the case on the merits. The Court adds that, should this petition be denied, the stay will automatically terminate. Otherwise, the stay “shall terminate upon the issuance of the judgment of this Court.”
While the substance of the order offers little insight into how the Court will ultimately decide this case, the final sentence of the order does: “The Chief Justice, Justice Scalia, Justice Thomas, and Justice Alito would deny the application.” Notably absent from this list of dissenting justices is Justice Anthony Kennedy, a wingnut who typically votes with his fellow wingnuts in abortion cases, but who has also refused to overrule Roe v. Wade outright.

The shear volume of bullshit, lunacy, utter stupidity and complete insanity coming from the wingnuts in the past week or so has been a bit much (it's as if they think that spewing so much filth they can cover up the fact they are morally and ethically bankrupt), it has made it somewhat difficult to keep up with them in our current format here at The Truth Be Told.

Harry Reid tells BLM's Burning Man squad to suck it up

The senator from Nevada scoffed at the Bureau of Land Management's demand that Burning Man build it a $1m VIP compound with showers and flush toilets, saying that the festival's ethic of radical self-reliance should extend to its Fed minders.
“While I agree that the BLM should take its permitting duties seriously and work with Burning Man to both guarantee the safety of its participants and the protection of the environment, providing outlandishly unnecessary facilities for the BLM and its guests should be beyond the scope of the permitting requirements. Part of Burning Man’s philosophy is self-reliance and living with the elements is part of the experience. Flush toilets and laundry facilities can be found about ten miles away in Gerlach, Nevada, if BLM’s employees need such amenities,” Reid wrote, noting that he was an author of the legislation that designated the area a federally protected space.
According to the Reno paper, the request by the BLM is “unprecedented” in Burning Man’s more-than-two decade history, and would increase its 2015 permit fees to around $5 million. Burning Man organizers have refused so far to comply with the BLM’s request for the so-called Blue Pit compound.

Democratic presidential candidate Bernie Sanders predicted on ABC’s This Week that he will win Iowa, New Hampshire, the Democratic nomination, and be the next president of the United States.

We are going to win New Hampshire. We are going to win Iowa, and I think we are going to win the Democratic nomination, and I think we’re going to win the presidency.
And I’ll tell you why, George, the American people are sick and tired of seeing the disappearance of the great middle class of this country. They’re sick and tired of working longer hour for lower wages while at the same time 99 percent of all new income generated is going to the top 1 percent and the top one-tenth of 1 percent now owns almost as much as wealth as the bottom 90 percent.
George, we have seen in the last 30 years a massive shift in wealth and income from ordinary Americans to the richest people in this country and the American people are saying, ‘Enough is enough.’ We need to create an economy that works for all of us and not just a handful of billionaires.
No political candidate is going to say that he/she has no chance of winning, but the confident attitude of Senator Sanders is increasing justified by the size of the crowds coming out to support him, the millions of dollars he is raising from small donors, and the gains that he is making in the polls.
The reason Sanders has seen such a surge is that he is the only candidate in either party who is addressing the anger and angst of non-wealthy Americans. Hillary Clinton is talking about programs to rebuild the middle-class. Republicans are dropping the words middle and class into all of their speeches as if they are the secret passwords needed to gain entry into the White House, but only Bernie Sanders is expressing the emotions and feelings of those who have been battered by the Great Recession.
People are hurting, and they are angry at an unfair system that is blocking economic advancement for most for the benefit of the few at the top.
Bernie Sanders is speaking to and for those people, and this is why a small Senate very liberal senator has become a serious threat to business as usual in Washington.

(Image source: mprnews.org) An annual CNBC scorecard that rates each state on 60 measures of competitiveness finds that Democratic run Minnesota is the best state in the country for business in 2015. The same study found that while Republican-controlled states like Kansas and Arizona experienced sharp declines in their business competitiveness, Minnesota Democratic Governor Mark Dayton’s economic miracle has turned his state into the nation’s best state for businesses.
When Mark Dayton took office in 2011 he inherited a 6.2 billion dollar deficit from his Republican predecessor, Tim Pawlenty. Four years later, after passing a huge tax increase on wealthy Minnesotans, the state now has over a 2 billion dollar surplus, and one of the lowest unemployment rates in the country. Dayton’s Minnesota is the antithesis of Sam Brownback’s failed supply-side experiment in Kansas and Scott Walker’s union busting disaster in Wisconsin.
While the CNBC study acknowledged that Minnesota’s business tax rates were relatively high, they found that other factors like a strong education system and a good quality of life, offset high taxes in making the state more business-friendly than many other states with lower corporate tax rates.
In discussing the scorecard, CNBC’s analysts credited Mark Dayton for Minnesota’s success even though they acknowledged that his approach was not what economists or corporate leaders usually label “business-friendly” policies. The article reads in part:
But Minnesota doesn’t just stumble into the top spot by accident. The state’s path to the top is marked by a carefully crafted and still controversial strategy by Gov. Mark Dayton, the first Democrat to hold the office in two decades. The hallmark of his plan is something most governors seeking to win the hearts of business would never dream of: a big tax increase.
The tax increase on the wealthy worked. By increasing the state’s revenue and putting more money in the pockets of ordinary Minnesotans, Dayton’s economic plan spurred economic growth and reduced unemployment. The healthy economy that came about in the wake of those tax increases not only benefited workers, it also in turn proved good for business.
At some point supply-side loyalists will have to stop ignoring Minnesota’s economic success, and come to terms with the fact that the best place to do business in America isn’t where the taxes on the rich have been cut , but rather where they have been raised.
Minnesota is a shining example of how Democratic policies can help everyone prosper. Now if only the rest of America would start paying attention, instead of continuing to be hoodwinked by the empty promises of the Republican cabal’s trickle down fantasies bring about economic failure in practice.

In yet another blow to Republicans, their furious scrambling from 2016 Democratic presidential candidate and Secretary Hillary Clinton’s assault on their efforts to disenfranchise American citizens has been called out. They are wrong; Hillary Clinton was right. Ugh, reality, so mean.
Speaking at Texas Southern University on June 4th, 2015, Hillary Clinton charged that you can vote in Texas with a concealed-weapon permit, but not a student ID. Clinton said, “If you want to vote in this state, you can use a concealed-weapon permit as a valid form of identification, but a valid student ID isn’t good enough.”
PolitiFact Texas ruled her statement to be “true” because they found the following work for ID in Texas:
• A Texas driver license issued by the Texas Department of Public Safety.
• Texas Election Identification Certificate issued by DPS.
• Texas personal identification card issued by DPS.
• Texas concealed handgun license issued by DPS.
• U.S. military identification card containing the person’s photograph.
• U.S. citizenship certificate containing the person’s photograph.
• U.S. passport.
So, yes to voting in Texas with a concealed handgun license but no-go for someone presenting a student ID.

Naturally, there was outrage and denial at having their actual laws called out.
The wingnut National Review was outraged, declaring “Hillary Clinton made so many false assertions about voting in the speech she gave at Texas Southern University that it’s hard to know where to start. Contrary to her contention, no “barriers” are being imposed on eligible Americans.”
Much moving of the goal posts followed in order to end on high ground.
Americablog detailed a long list of Republicans outraged by Hillary Clinton calling out their efforts to disenfranchise large segments of the population who tend to vote for the opposition. Republicans pretended that they are making it easier for people to vote, sometimes clinging to the life raft of a law put into place that they opposed, pretending to own it, just to deflect and diffuse the harsh glare of reality steaming at them from Hillary Clinton’s warning shots.
PolitiFact’s Texas office stepped in to address the residual denials after the main PolitiFact found “mostly true” Clinton’s charge that a federal court pointed out that the purpose of these voter ID laws is to discriminate against minorities.
They say “mostly” because the judge did say this, but the ruling is under appeal. This is actually not “mostly true”, it is historically all the way true and it remains true today and there is data to back it up. There is no other reason for a party that can’t win if minorities vote to spend so much money misleadingly selling laws meant to make it harder for minorities to vote. Voter fraud is so rare that it is less likely than being hit by lightening. But whatever.
Now, what kind of patriot would argue against every eligible citizen being not just allowed to vote, but encouraged to vote by a process that was not such a hardship? The same kind of “patriot” who only wants those who agree with them to vote, which is to say, not a patriot at all.
Hillary Clinton scares Republicans. This is not the last time you will see them freak and scatter in reaction to her. This isn’t her first rodeo, Republicans better hang on.

During an interview on CNN’s State Of The Union, Republican presidential candidate Donald Trump lied and claimed that he is drawing big crowds just like Democratic candidate Bernie Sanders.

TAPPER: You think Bernie Sanders can beat her?

TRUMP: Well, he’s making a lot of progress. You know, you would have said, and I’ve watched him. I’ve seen his crowds. I get crowds that are fantastic too. He’s got that. He’s got a lot of people going to see him. Do I think so? No, I don’t think so. But you know stranger – hey, you been in this world a long time. Stranger things have happened.

TAPPER: Some people look at you running for president and say, this is just about ego, getting his brand out there. What’s your message to those people?

TRUMP: My message is that they’re wrong. It’s something that I’ve looked at over the years. I looked at it very seriously as you know, four years ago. I’ve been thinking about it very seriously over the last period of time and I’ve decided I’m going to do it.
Bernie Sanders is drawing thousands upon thousands of people to his events while Donald Trump paid actors to dress up like supporters and cheer for him at his campaign launch.
The media has already been trying to create a false equivalency between Bernie Sanders and Donald Trump. The reality is that Sanders is a dedicated public servant who has held office for decades while Trump is a reality television star who has never done anything in the public service realm.
Sanders and Trump have nothing in common. Donald Trump is an example of the kind of entitled billionaire that Bernie Sanders is leading a revolution against. Donald Trump is a professional carnival barker and self-promoter who will do and say anything for media attention.
Bernie Sanders is leading a true grassroots movement that Donald Trump is trying to latch his bogus presidential campaign on to. Donald Trump is hiring actors to pretend to support him. There is no comparison between Trump and Sanders, and those in the media who are enabling Trump’s lies deserve the public’s scorn.

Alright then, someone is trying to hide the fact they are oh so stupid - the accompanying video has been deleted and the account holder who posted it had their account terminated.
But any sane person seeing this flag would be able to tell if the images on it were Arabic script even if they were unable to read the script or not.
However the reporter who 'broke' this story obviously could not tell what Arabic script looked like or recognize silhouettes of various sex toys.
If they had reported the flag as containing 'alien' or 'extraterrestrial' script on it it would be more believable.
