Just a few months ago, reformers were celebrating that most of the 2016 Republican cabal pack had signaled that, at least in theory, they supported retooling America's justice system. But, as has been the case with so many other sensitive issues, the entrance of Trump has changed the dynamic. Now instead of talking about criminal justice reform, the Republican cabal primary contenders are warning of a supposed nationwide crime spike, touting the mandatory-minimums in "Kate’s Law," and lobbing “soft on crime" accusations. “I’m concerned about the impact on the push for justice reform because we’re expecting a bill at some point this month,” Jason Pye, director of Justice Reform at the conservative FreedomWorks, told TPM. “I’m concerned about the impact of the rhetoric on that.”Yes, FreedomWorks is backing criminal justice reform. It's just one sign of the breadth of liberal and conservative entities—including the ACLU, NAACP, the Koch brothers and Grover Norquist—that have come together around the issue. So is there hope? Maybe. It's all a question of how nervous the campaign trail rhetoric makes lawmakers on Capitol Hill. Nice work, Trump.
Gun-Nut Agitators Claim Criminals Don’t Follow Gun Laws
Here’s the Research That Shows They’re Wrong.
How the right kind of regulations deter criminals from getting guns.
Despite the fact that mass shootings are predominantly an American
phenomenon, gun advocates are quick to insist that there is nothing we
can do to prevent them. Instead, they suggest these murders could only
be reduced by having more armed civilians — aka “good guys with guns” —
roaming the streets, a solution that inevitably involves fewer gun
regulations and more gun ownership. Reducing gun violence through
straightforward policies of the sort implemented in virtually every
other industrialized nation is regarded as a chimera by the National
Rifle Association. After all, criminals don’t follow laws, so what would
be the point?John R. Lott, the author of More Guns, Less Crime, recently evoked a version of this slogan in a piece for The Daily Caller, arguing that closing the loopholes in the background check system would not have stopped the Charleston mass shooting from happening. The alleged killer’s record included an admission of drug use that should have blocked the purchase when he bought his Glock from a licensed dealer, but an FBI examiner didn’t catch it in time and the sale was allowed to go through by default. Even if had been denied, Lott reasoned, “[i]t seems hard to believe that he couldn’t have figured out some way of obtaining a gun.”
What makes this line of reasoning especially pernicious is that it extends beyond mass shootings, deployed by pro-gun activists and politicians as an indictment of any laws regulating firearms. As Rubio, a Republican pretender candidate, likes to say, “My skepticism about gun laws is criminals don’t follow the law. They don’t care what the law is, you can pass any law you want and criminals won’t follow it.”
It turns out, however, that the scientific evidence suggests precisely the opposite: criminals routinely respond to incentives, and policies such as background checks and permit-to-purchase requirements demonstrably save lives by reducing criminal access to firearms. The problem, these studies show, isn’t that criminals don’t follow laws, but rather that criminals aren’t dissuaded by weak laws. And gun laws in all but a few states are decidedly weak.
‘Responsible’ Minnesota Gun Owner Shoots Teen Girl For Asking Him Not to Ride Mower in Her Yard

Investigators found three .45-calibre shell casings in the grass near the deck where it appeared someone had been lying in the grass under a pine tree. The girl told investigators that a man who lived nearby had been riding his mower through her yard, and that he regularly carried a pistol in a holster. She said that she had spoken to him about trespassing, and that he denied her allegation.
Officers searched Pickering’s home and found a .45-caliber semiautomatic pistol with a holster hidden in the air vent. Pickering, however, claimed that he had not seen the gun in a week or so. He attempted to explain away the fresh grass stains on his jeans he said he might have gotten the stain kneeling to hook a trailer to his mower.
When investigators pointed out some inconsistencies in his story, Pickering said he had taken his children for a ride with the mower. After he returned home, the girl came to his front door to confront him about riding the mower through her yard. Pickering admitted that he went to her house, knelt by a pine tree, and shot her after she came out the door. He then said he hid the gun and holster in the vent.
Pickering is being held on $300,000 bail and has been charged with felony attempted first-degree murder.

Prosecution Is Not Persecution
There’s been a lot of yammering about a certain
Kentucky lady who has been “air quotes” “persecuted” for her beliefs
that Teh Gays can suck it, and not in the Dan Savage GGG way. But while
she keeps using that word, we don’t think it means what she thinks it
means. The word she is looking for is “prosecuted,” which is what
happens when one breaks the law. While they sound the same, they are
actually very different concepts.
The Kim Davis ordeal reveals a frightening truth about a desperate, radicalized 'christian' religio-wingnuts
The saga of Kim Davis, the Kentucky county clerk who went to jail for a
weekend rather than sign off on same-sex marriage certificates, might
seem like it’s a last gasp for the anti-gay right; an attempt to eke out
some kind of victory after having lost their two-decade fight against
same-sex marriage. Unable to stop same-sex couples from marrying, Davis,
along with a handful of anti-gay florists and bakers, strives instead
to just make getting the license an embarrassing hassle. It’s childish
sore loser behavior, the equivalent of a baseball player pouting in the
dugout and refusing to shake hands with his opponent because he didn’t
win the game.
Because of this, liberals can be forgiven for laughing and moving on,
not particularly worried about Davis, whose temper tantrum isn’t even
preventing the licenses from being issued any longer, as the judge
authorized her deputies to hand them out.
Unfortunately, though, Davis’s behavior isn’t just a bratty tantrum. This whole incident is also a sign of a troubling development in the religio-wingnuts: As their cultural power declines in the face of growing diversity and liberalism, religio-wingnuts are embracing scary levels of radicalism. They don’t have the numbers anymore, so they are turning to scarier and more radical demands to seize power in any way that they can.
No doubt Davis is a comical figure whose self-righteousness is only equaled by her ignorance both of the text of the bible she clings to and what it means to have a job as a government employee. But she’s being used by her legal team and other religio-wingnut leaders to spread the idea that religio-wingnuts are entitled to ignore — or even overthrow — democracy and seize power just because they feel like it.
Some supporters, like Ryan Anderson of the New York Times, are claiming that Davis wants an “accommodation” for her religious delusions. This is, to put it bluntly, a lie. Davis was offered just such an accommodation and told that she doesn’t have to personally issue the licenses so long as her deputies were allowed to do so. She declined that compromise, insisting that she be able to actually prevent same-sex couples from getting licenses in her county altogether.
What Davis is asking for is not an accommodation at all, but for the right to declare, by fiat, that Rowan County, Kentucky, is a mini-theocracy not beholden to the laws of the land, but by the whims of Kim Davis. Her legal team wants you to see her as a sweet but faithful woman, but in fact she’s trying to pull a coup here, claiming that “dog’s authority” — read Kim Davis’s authority — trumps our entire democratic system.
It’s not just her, either. Rena Lindevaldsen, who works for the Liberty Counsel that is handling Davis’s case, has taken to boldly arguing that 'christians' have the right to overthrow the democratically elected government and simply impose their will by fiat. “Whether it’s zoning or taxes or marriage or abortion, in those issues, government doesn’t have authority to say that these things are appropriate because they’re contrary to scripture,” Lindevaldsen recently argued in front of Liberty 'University'. Which is to say that even though the government has declared abortion legal, if you decide you don’t want your neighbors getting abortions, you should be able to declare yourself a dog-appointed authority and simply shut it down. If you don’t want to pay taxes, declare yourself a “sovereign citizen.”
Mike Huckabee has been at the frontlines of pushing the claim that 'christian' religio-wingnuts simply have the right to ignore or overturn democracy to impose their will, and not just because he’s been running around Kentucky, trying to get himself on camera as much as possible in support of Davis’s attempt to ban gay marriage by fiat. He’s also been using the campaign trail to argue that the president should be able to simply end rule of law and start ruling like a dictator.
He doesn’t use the word dictator, of course, but make no mistake, Huckabee has repeatedly and shamelessly promised that if he is elected president, he will start declaring his beliefs to be the law of the land without the cooperation of Congress. In a Google hangout, he laid out the scheme: Declare as president that there are “constitutional rights of the unborn” and simply ban abortion by fiat. He claimed a similar authority during the Republican 'debate', a moment that got startlingly little play even though it was literally a candidate for president arguing that he would make himself a dictator.
Despite his regular references to the constitution when making these proclamations, Huckabee’s scheme would mean voiding out the constitution, as well, and not just because, despite his claims to the contrary, there is not a single word in it that gives citizenship status to embryos. It’s also because his scheme would mean ending the balance of powers, concentrating all the power of the legislature and the courts into the hands of the president.
And once you believe that your interpretation of what dog wants trumps rule of law, not just for yourself but for your neighbors, then it follows very quickly that you are entitled to use force and even violence to get your way.
Some religio-wingnut leaders are, in fact, making noises that sound very much like justifying the use of violent force in order to overturn the social progress brought upon the U.S. from the democratic system. “No one should want it and no one, myself included, does want it,” conservative pundit Erick Erickson argued in an op-ed about the Davis case. “But how much longer until we have another civil war?” You can be forgiven for being skeptical of his claim not to want this, of course. On the contrary, it reads very much like a threat: Either give up the gains made under the democratic system or face violent overthrow by religious fanatics.
Huckabee plays the same game of fantasizing about violent struggle to overturn democracy while pretending to abhor violence. In his Google hangout, he said that he expected that banning abortion by fiat would likely result in “extraordinary pushback, and goodness, perhaps riots in the streets.” He’s not wrong that simply dissolving rule of law and declaring yourself the sole authority would likely result in people resisting, but he shrugged this off as merely the price of doing business.
To be clear, all these fantasies of governmental overthrow to stop gay couples from marrying will likely remain fantasies. The religio-wingnuts are aging and losing numbers quickly. This is why they’re getting increasingly fanatical in their rhetoric, of course, but it also makes it hard to imagine they could really get it together to act out their fantasies of seizing power by force.

The fact that so many Republican candidates were afraid to defend the rule of law and denounce Davis for her actions is a troubling symptom of this. The 'christian' religio-wingnuts may not be up to armed revolution, but they are increasingly demanding that Republicans turn their backs on the basic rules of democracy to cater to a theocratic minority. That Republicans are listening is a danger to us all.

California Senate Makes Voting Easier By Passing Motor Voter Act
The California State Senate passed the California New Voter Act on a 24 to 15 vote.…
While Republican misled states are making it harder to vote through various forms of voter suppression, California took a step in the other direction. The California State Senate passed the California New Voter Act on a 24 to 15 vote. The measure automatically registers any California resident who obtains a driver’s license, and who is also legally eligible to vote. The measure would add an individual to the eligible voter rolls, unless the person chooses specifically to opt out of getting registered to vote.
The bill’s original sponsor, 80th District
Assemblywoman Lorena Gonzales (D-San Diego), patterned the measure after
a similar law that was recently passed in Oregon. Gonzales argued:
The California New Motor Voter Act is a simple, common-sense opportunity to streamline and modernize our voting system to bring millions of eligible voters into the electoral process and rebuild the relationship between the public and their representatives.
Predictably, frightened Republicans balked at the
measure, knowing full well that when more people vote, they are less
likely to win elections. This is one reason that the Republican cabal is working so
hard to erect barriers to voting in any state where they have a
governing majority.
In California, however, Democrats control both
houses of the legislature and the Governor’s mansion. So instead of
passing voter suppression laws, they, along with Oregon, are working to
increase voter turnout, rather than attempting to squash it.
Even without the Motor Voter Act in place, the
Republican cabal is in sorry shape in California. Democrats not only
enjoy lopsided majorities in the legislature, but they also hold all
eight major state wide offices, leaving the Republican cabal virtually shut out from
wielding any political power in Sacramento.
The Motor Voter Act won’t alter the balance of power
in California, but it will make it easier for people to get registered
to vote so that they can cast their ballots. With the increase in
turnout, the Republican drought in California is all but certain to
continue. When people turn out to vote, Democrats win, and that is
especially true in California, where they already hold a decisive
political advantage.
Too many political candidates spoil the stew

During his rally in Dallas, Texas, Republican pretender candidate Donald Trump admitted that his speeches are about
nothing.
Trump said, “On Fox and CNN they call it all Trump
all the time. And by the way, their ratings are through the roof. If
they weren’t, they wouldn’t cover me, I’ll be honest. It’s a very simple
formula in entertainment, in television. If you get good ratings. If
you get good ratings, and these aren’t good, they are monstrous then you
are going to be on all of the time, even if you have nothing to say.”
Trump is saying nothing in his speeches, except the
word great and a promise that America will also be great if he is 'elected' pretender. Trump is gaming the media. He gets in front of
the microphone and babbles on about nothing. For example, Trump
announced his plan to repeal and replace Obamacare with “something
great.” In case we missed all of the details that Trump was dropping, he
repeated that he was going to replace access to affordable healthcare
with something great.
The media knows that they are being
conned, but they continue to cover Trump’s every move because
they are have convinced themselves that Trump equals ratings.
The media created Trump’s surge in the polls
by giving him daily free media coverage. If the media stopped covering
Trump tomorrow, he would plummet in the polls. While Trump’s endless
media coverage about nothing is annoying, he is doing Democrats a huge
favor by taking away potential media coverage from more serious
candidates.
Each cable news network knows that Trump’s
speeches are not newsworthy, but they continue to give every one of them
live coverage. Trump has no policy solutions. Trump is offering no
answers. His campaign is based on the idea that America is bad right
now, but he can make it great.
Trump admits that he is saying nothing, but the
networks are still flocking to cover him. Because in America’s
controlled corporate media, ratings are more important than informing
the public.

Wisconsin's idiot Walker has dipped to 2 percent support in the
latest Washington Post-ABC News national poll of the Republican cabal pretender
race. With his poll numbers in free fall, Walker has decided to step up
his war on American workers. Walker is hoping to use attacks on unions
and working class Americans as a way to reinvigorate the Republican
base. The idiot hopes his anti-worker message will restore his
popularity with the wingnut voters who have abandoned him in droves since
mid-summer.
The Wisconsin idiot has earned a reputation for
being anti-worker, but because of his flagging poll numbers, Walker is
trying to revive his campaign by reminding America just how anti-worker
he can be. Running against American workers seems a dubious strategy at
best. However, Walker’s success in stealing elections in Wisconsin
despite supporting virulently anti-union policies, may have given him
reason to believe that running against workers is a way to win
elections.
Walker plans to unveil his “new, improved” anti-worker plan on Monday at a town hall meeting in Las Vegas.
Walker’s plan calls for eliminating the National Labor Relations Board
(NLRB) and for making it illegal for federal workers to form labor
unions. In addition, he wants to pass a national so called “right to
work” law, in an effort to weaken unions nationwide.
Furthermore, Walker’s proposal
calls for repealing Barack Obama’s executive order requiring employers
to pay overtime to some salaried workers. Walker also plans to reverse
laws that require certain employers to provide paid sick leave for their
employees.
Scott Walker does not seem to understand why he has dropped to just two percent support
in the national polls. He has spent the past five years carrying water
for the Koch brothers and other billionaires, and now with his poll
numbers circling the drain, his solution is to double down by stepping
up his attacks on American workers.
The Koch brothers and the plutocrats in the
Republican cabal will love Walker’s new plan to escalate the war
against the nation’s working class. However, wingnut voters in Nevada, New
Hampshire and Iowa, might not be nearly as receptive. For the wingnut union truck driver, the wingnut middle manager at
McDonald’s, and the evangelical cult secretary who needs time off to
recover from an illness, Walker’s ideas are not going to be well
received.
Not every Republican shares Walker’s
contempt for working class Americans. By intensifying his war on paid
sick leave, overtime pay and union organizing, Walker may impress a few Republican cabal donors with deep pockets. However, with rank and file voters, the
Wisconsin idiot is essentially committing political suicide. A

Yet, here we are. If I criticize your favorite candidate, I become the enemy. If you criticize my favorite candidate, you’re the enemy. Doesn’t matter if we’re the same party. Doesn’t matter that we’re all Americans. Doesn’t matter that we’re all human beings.
You are either like me or you’re not. When did our great national debate become a feud?
Our hatred for one another appears greater than our understanding. Is this really what we ALL want?
Winds Of Change Blow Through South As Democrats Are Winning Special Elections On Wingnut Turf
For the second time in less than a month, a Democrat
has pulled off a stunning victory over a Republican candidate, by
flipping a State House race in an almost hopelessly red legislative
district. Democrat Cyndi Munson scored an improbable
54-46 victory in Oklahoma’s House District 85, a suburban district
Northwest of Oklahoma City. Since 1965, when the district was first
created, it had never been won by a Democrat. That changed on a Tuesday
night.
The 85th District went 61-39 for Mitt Romney in the 2012 election.
Yet, on Tuesday night, in a traditionally low turnout special election,
the district turned a surprisingly solid shade of blue. Speaking to
supporters after she’d won, Munson acknowledged the magnitude of her achievement, proclaiming:
Each time I heard it was an uphill battle I got more strength. This is amazing!
Munson lost her race for the same seat in 2014 by 13 points, but she battled back and emerged on Tuesday night a winner. She ran on a platform supporting education and women’s health,
while opposing income tax cuts for top earners. In a deep red district
her message resonated with voters, weary of the Republican cabal’s extremist
stranglehold on Oklahoma politics.
As astonishing as Munson’s victory was, it
was not the first Democratic upset of its kind this summer. In August,
Democrat Taylor Bennett pulled off a similar surprise in Georgia’s 80th
House District. Despite being outspent 2 to 1 in a district Mitt Romney carried by a 56-43 margin over Barack Obama in 2012, Bennett coasted to a 55-45 surprise victory over his Republican opponent, Max Davis.
Bennett won not by following the conventional wisdom
of downplaying social issues in the South, but by being outspokenly
liberal on social issues and standing firmly in support of LGBTQ
equality. Like Munson, he won in a special election, when turnout is
usually down and as a result, Republicans historically have enjoyed an
advantage. Not this time.
While it may be too optimistic for Democrats to take
the results of two special elections and call it a trend, it is worth
pointing out that in two heavily Republican districts in the South,
Democrats have overcome long odds to flip seats from red to blue. Maybe,
just maybe, those two victories are a sign of more to come, as
conservative voters join the rest of American in becoming fed up with
the Republicans’ inability to govern.
